TravelSync — Terms of Service (Closed Beta)

Version:
[0.1 — closed beta]
Effective date:
1 October 2026

1.About these terms

1.1These terms (the "Terms") are a contract between you and Forvosync Ltd, trading as TravelSync (company number 16960226, registered office 167-169 Great Portland Street, 5th Floor, London W1W 5PF, United Kingdom) ("TravelSync", "we", "us") for your use of the TravelSync web app at travelsync.cloud and any related apps or services (the "Service"). By creating an account or using the Service you agree to these Terms and our Privacy Notice and Cookie Policy. If you do not agree, do not use the Service.

1.2Summary in plain English (the full Terms govern): the beta is free; itineraries are AI-generated suggestions that you must check yourself; we do not sell travel or take bookings; features may change and beta data may be reset with notice; you keep your content and we keep ours; and nothing in these Terms takes away your legal rights as a consumer.

1.3Contact: support@travelsync.cloud. Legal notices to us: Forvosync Ltd, 167-169 Great Portland Street, 5th Floor, London W1W 5PF, United Kingdom.

2.Who can use the Service

2.1You must be at least 18 years old and a consumer (using the Service for personal, not business, purposes). By using the Service you confirm this. Business use requires a separate agreement with us.

2.2The closed beta is by invitation. We may accept or decline requests to join, limit the number of users, and end the beta at any time.

3.Your account and login

3.1To log in you use your email address and a password, or we email a single-use, time-limited link ("magic link") to your registered email address. Anyone with access to your inbox can access your account, so you must keep your password and your email account secure and must not share your password or forward magic links to anyone.

3.2You are responsible for activity on your account until you tell us at support@travelsync.cloud that it has been compromised. You must give us an accurate email address and keep it up to date. One account per person.

3.3You can delete your account at any time in account settings. Deletion is described in the Privacy Notice.

4.What the Service does — and does not do

4.1The Service generates draft travel itineraries and place suggestions from the information you give us (destination, dates, interests, notes) using an artificial-intelligence language model provided by a third party (currently Anthropic) and place data from Google Maps Platform. Itineraries are labelled as AI-generated in the Service.

4.2AI-generated content may be wrong. AI models can produce information that is inaccurate, out of date, incomplete or invented (for example, places that have closed, wrong opening hours, prices, addresses, distances, travel times, visa or safety information). Before relying on any itinerary you must verify opening hours, prices, availability, transport, safety and entry requirements with the venue, an official source or a travel professional. You use itineraries at your own risk and judgement.

4.3The Service is not professional travel, safety, medical, legal or financial advice and is not a travel agent, tour operator or package organiser. We do not sell, arrange or take responsibility for any transport, accommodation, activity, ticket or table. The Package Travel and Linked Travel Arrangements Regulations 2018 do not apply to the Service.

4.4Place information (names, ratings, opening hours, photos, maps) comes from Google Maps Platform and is subject to Google's terms and privacy policy; we display it with the required attribution and do not control or guarantee it.

4.5Third-party bookings and affiliate links (not active in beta). After the beta, the Service may include links to booking partners such as Viator, GetYourGuide, TheFork and Tiqets. Any booking you make is a contract between you and that partner on their terms; we are not a party to it and are not responsible for the partner's services, prices, cancellations or refunds. We may receive a commission if you book through a link. Such links will be clearly labelled (for example "Ad" or "Affiliate link") as required by the CAP Code and the Digital Markets, Competition and Consumers Act 2024. A commission never affects the price you pay.

5.Acceptable use

5.1You must not: (a) use the Service unlawfully, or to harm, harass or deceive anyone; (b) upload content that is illegal, infringes others' rights, or contains malware; (c) try to break, overload, scrape, reverse-engineer or gain unauthorised access to the Service, its AI prompts or its data, or use bots or automated tools except as we allow; (d) use the Service to build a competing product or dataset, or to extract Google Maps data other than as displayed to you; (e) attempt to make the AI produce unlawful, hateful or dangerous content, or content that violates our AI provider's usage policies; (f) share, sell or transfer your account; or (g) remove any AI-generated-content label or attribution.

5.2We may suspend or remove content or accounts that we reasonably believe breach this section, and we may report unlawful activity to the authorities.

6.Your content

6.1"User Content" means anything you enter into the Service (trip details, interests, notes, feedback). You own your User Content. You grant us a worldwide, non-exclusive, royalty-free licence to host, store, copy, process, transmit and display your User Content — including sending it to our AI and mapping providers — for the purpose of operating, securing and improving the Service and as described in the Privacy Notice. This licence ends when you delete the content or your account, except for backups (deleted within the period in the Privacy Notice) and content you have shared publicly.

6.2You confirm that you have the right to give us your User Content and that it does not infringe anyone's rights or break the law. Do not include other people's personal data unless you are entitled to.

6.3Feedback. If you give us ideas, suggestions or bug reports about the Service, you agree we may use them without restriction or payment. We will not claim you gave us any other rights in your User Content.

6.4We do not use your User Content to train AI models, and our AI provider is contractually prohibited from doing so. [Confirm against the Anthropic Commercial Terms in force.]

7.Our intellectual property

7.1The Service — including its software, design, text, logos, trade marks, databases, prompts and the way itineraries are compiled and presented — is owned by or licensed to TravelSync and protected by copyright, database right, trade mark law and other rights. We grant you a personal, non-exclusive, non-transferable, revocable licence to use the Service for your own non-commercial travel planning while these Terms are in force. You get no other rights.

7.2Generated itineraries. To the extent we hold any rights in an itinerary generated for you, we license it to you for your personal use, including sharing it with your travel companions. You may not sell itineraries or present them as a professional product. [DECISION: alternatively assign output rights to the user outright; note that AI output may have limited or no copyright protection.]

8.Beta terms

8.1The Service is provided during the beta free of charge and "as is" for testing and evaluation. Nothing in this clause limits your statutory rights (see clause 10).

8.2During the beta: (a) features may be added, changed, limited or removed at any time; (b) the Service may be unavailable, slow or contain bugs, and there is no service-level commitment; (c) we may impose usage limits (for example on the number of itineraries per day); (d) we may need to reset or delete beta data, including saved trips — we will give at least [7 days'] notice by email and let you export your trips first, except where a reset is required urgently for security or legal reasons; and (e) we may end the beta, or your participation in it, at any time on notice.

8.3Beta features, screens and non-public information we share with you are confidential until we make them public; please do not publish screenshots or details without asking us. You are free to talk about your general experience.

8.4If we launch paid plans, we will tell you in advance what changes, and you will never be charged without agreeing to the subscription terms (the Annex is a draft of these).

9.Availability, changes and ending the Service

9.1We may change the Service and these Terms. For changes to these Terms that materially affect you, we will email account holders at least [14 days] before they take effect and post the new version with its effective date. If you do not agree, stop using the Service and delete your account before the effective date. Changes required by law or for security may take effect immediately.

9.2We may suspend the Service for maintenance, security or reasons outside our control, and will try to give notice where practical.

10.Our responsibility to you

10.1Nothing in these Terms excludes or limits our liability for: death or personal injury caused by our negligence; fraud or fraudulent misrepresentation; breach of your statutory rights as a consumer, including under the Consumer Rights Act 2015 (for digital content: that it is of satisfactory quality, fit for purpose and as described; and that we will compensate you if digital content we supply damages your device or other digital content and we failed to use reasonable care and skill); or any other liability that cannot be excluded or limited by law.

10.2We are responsible for loss or damage you suffer that is a foreseeable result of our breaking these Terms or failing to use reasonable care and skill. Loss is foreseeable if it is obvious it will happen or if, when the contract was made, both we and you knew it might. We are not responsible for loss that is not foreseeable.

10.3Subject to clause 10.1, we are not responsible for: (a) loss caused by relying on AI-generated itineraries or third-party place data without verifying them (clause 4); (b) any booking, service or product provided by a third party (clause 4.5); (c) loss of beta data where we gave the notice described in clause 8.2(d); (d) loss caused by unauthorised access to your email account; or (e) business losses — the Service is for consumers only.

10.4Subject to clause 10.1, because the beta is free, our total liability to you for all claims arising from the beta is limited to [£100]. Once paid plans launch, this cap will be replaced by the amount in the Annex. [DECISION: cap amount — counsel to confirm the cap is fair under the CRA 2015 s.62 given the Service is free.]

10.5We are not liable for delay or failure caused by events outside our reasonable control (including failure of our AI, mapping, hosting or email providers), but we will take reasonable steps to minimise the effect on you.

11.Ending these Terms

11.1You may end these Terms at any time by deleting your account.

11.2We may suspend or close your account: (a) immediately, if you seriously or repeatedly breach these Terms, if required by law, or for security reasons; or (b) otherwise on [14 days'] notice by email, including when the beta ends. On closure your right to use the Service ends and your data is handled as described in the Privacy Notice. Clauses 4, 6.3, 7, 10, 12 and 13 survive.

12.Complaints and disputes

12.1If you have a problem, please contact support@travelsync.cloud first — we aim to reply within [5 working days]. We are not required to use, and do not currently subscribe to, an alternative dispute resolution (ADR) scheme. [DECISION: whether to offer an ADR provider voluntarily at launch.] These Terms do not require you to arbitrate; you can always bring a claim in court.

12.2These Terms are governed by the law of England and Wales. You can bring proceedings in the courts of England and Wales; if you live in Scotland or Northern Ireland you may also bring proceedings in your local courts, and if you live elsewhere you keep any protection of your local mandatory consumer law.

13.General

13.1These Terms, the Privacy Notice and the Cookie Policy are the whole agreement between us for the beta. If any part is found unenforceable, the rest continues. If we do not enforce a term immediately, we can still enforce it later. You may not transfer your account or these Terms; we may transfer our rights and obligations to a successor business on notice, provided your rights are not reduced. No one other than you and us has rights under these Terms (Contracts (Rights of Third Parties) Act 1999). These Terms are in English.

Annex — Subscription Terms

DRAFT FOR LAUNCH — NOT ACTIVE IN THE BETA. No payment is taken and no subscription exists during the beta. This Annex will become effective only when we publish it with an effective date and you sign up to a paid plan.

A1.Plans and pre-contract information

A1.1Before you subscribe we will show you, clearly and on the same screen as the "subscribe" button: the plan name and what it includes; the price including VAT and how often it is charged; whether there is a free trial or introductory price, how long it lasts, and the price you will pay afterwards; that the subscription renews automatically until you cancel; the minimum commitment (if any); how to cancel and the notice needed; your 14-day cooling-off right; and the point at which you will first be charged. We will also send this information to you by email in a durable form immediately after you subscribe.

A1.2Current planned plans [confirm]: TravelSync Plus — £13.49/month, or £97.09 for 12 months (3- and 6-month plans: £36.41 and £60.68), including [●]. Prices are in pounds sterling and include VAT. We may offer different plans and prices in other countries.

A1.3Payments are processed by [Stripe / Apple / Google — ●]. We do not store your full card details.

A2.Free trial and conversion

A2.1If a plan includes a free trial, you will not be charged during the trial. We will send you a reminder email at least [3 days] before the trial ends telling you the date and amount of the first charge and how to cancel. If you cancel before the trial ends, you pay nothing.

A2.2A second 14-day cooling-off period starts on the day the trial converts to a paid subscription (and, after the DMCCA subscription rules commence, on each renewal where the law requires). If you cancel within it you get a full refund of that charge, less a proportionate amount for any period of paid service you used if you asked us to start the service immediately.

A3.Cooling-off and refunds

A3.1You have 14 days from the day you subscribe to cancel for any reason and receive a full refund. If you want the paid features immediately during the 14 days, we will ask you to confirm this expressly; if you then cancel within the 14 days we may deduct a proportionate amount for the days of service you used. We will refund within 14 days of your cancellation using the payment method you used.

A3.2After the cooling-off period, cancelling stops the next renewal; you keep access until the end of the period already paid for. [DECISION: whether to give pro-rata refunds on annual plans after cooling-off — DMCCA allows a contract to specify; CMA guidance favours generosity for long-term plans.]

A3.3If the paid Service is faulty, not as described or we cannot provide it, you have your Consumer Rights Act 2015 remedies (repair, replacement, price reduction or refund) in addition to anything in this Annex.

A4.Renewal and reminder notices

A4.1Subscriptions renew automatically at the end of each billing period at the then-current price for your plan. We will send a renewal reminder by email: (a) before the first renewal after any free trial or introductory price; (b) before each renewal of an annual (or longer than [6 months]) plan, at least [14 days] before; and (c) for monthly plans, at least [every 6 months] and at any time before a price change. Each reminder will state the renewal date, the amount, and how to cancel.

A4.2If we change the price, we will give at least [30 days'] notice by email before the change applies to you, and you may cancel before then without penalty.

A5.Cancelling — as easy as signing up

A5.1You can cancel at any time in Account → Subscription → Cancel in no more steps than it took to subscribe, or by emailing support@travelsync.cloud with the word "cancel". We will confirm cancellation by email within [2 working days]. We will not require you to phone, chat or give a reason. If you subscribed through an app store, cancel through that store.

A6.Liability under paid plans

A6.1Clause 10 of the Terms applies. For paid plans, the cap in clause 10.4 is replaced by: the greater of [£250] and the total amount you paid us in the 12 months before the event giving rise to the claim. Clause 10.1 carve-outs are unaffected.

A7.Other

A7.1Subscriptions are personal and non-transferable. We may suspend paid features if a payment fails after we have notified you and given at least [7 days] to update your payment method. Taxes are included in the price shown unless stated. This Annex is part of the Terms; if it conflicts with the main Terms about subscriptions, the Annex prevails.
